BvCM Federal Congress 2016 – reform of the law on avoidance in insolvency proceedings becomes top priority

On 12th and 13th October 2016 the Historical Town Hall in Wuppertal was at the center of the credit management. Around 600 participants followed the invitation of the Bundesverband Credit Management e.V. (BvCM) and attended its 13. Federal Congress. This year’s event focused on the future of credit management. According to the motto “Reliable credit management in turbulent times”, numerous lectures and workshops informed on challenges the credit management has to deal with in the near future, changes the field is facing and the role the credit manager will play in the next few years.

PASCHEN Rechtsanwälte was one of the exhibitors at the event and contributed also to the event’s lecture program. Concerning the topic of the law on avoidance in insolvency proceedings, attorney at law and leader of the BvCM insolvency practice group, Michael Schmidt, gave advice on the management of instalment contracts. Attorney at law Lutz Paschen reported in his function as capital representative of the BvCM on recent developments at the reform of the law on avoidance in insolvency transactions. At the same time he asked the congress participants for assistance: By an open letter addressed to the federal ministers Heiko Maas and Wolfgang Schäuble the BvCM demands to push a rapid conclusion of the reform. The reason for that is the current delay in the legislative procedure due to continuing discrepancies between representatives from the Federal Ministries of Finance and Justice. The participants supported the BvCM’s demand. 254 of them even affirmed by their signature how important a prompt implementation of the legislative reform is for them.

Overall, this year’s event was a full success. “In Particular the topic e-commerce attracted a great deal of interest”, Jan Schneider-Maessen, chairman of the BvCM, summed up. The next Federal Congress will probably take place 25th and 26th October 2017 in Kassel.
